Overtime Pay Formula

Standard US overtime (FLSA): 1.5× regular rate for hours over 40/week

OT Pay = Regular Rate × 1.5 × OT Hours
Regular Rate = hourly wage
1.5× = time and a half
OT Hours = hours worked beyond 40/week
Total Pay = (40 × rate) + (OT hours × rate × 1.5)
💡 Federal law (FLSA): Non-exempt employees must receive 1.5× their regular rate for all hours over 40 in a workweek. Some states (CA, CO) have daily overtime rules too.

US Overtime Rules

🇺🇸 Federal (FLSA)

1.5× for hours over 40/week. Applies to all non-exempt employees. No daily overtime rule.

🌴 California

1.5× after 8 hrs/day AND after 40 hrs/week. 2× after 12 hrs/day or 7th consecutive day.

⛰️ Colorado

1.5× after 12 hrs/day and after 40 hrs/week. More protective than federal rules.

💼 Exempt Employees

Salaried employees earning over $684/week may be exempt from overtime under FLSA.

Step-by-Step Guide

Find your regular hourly rate

For hourly workers it's simple. For salaried: divide annual salary by 52 weeks, then by standard weekly hours. $52,000 ÷ 52 ÷ 40 = $25/hour.

Count overtime hours

Overtime = total hours worked – 40 (or daily threshold in your state). Example: 48 hours – 40 = 8 overtime hours.

Calculate overtime pay

OT Pay = 8 hours × $25 × 1.5 = $300 overtime pay.

Add to regular pay

Regular: 40 × $25 = $1,000. Total: $1,000 + $300 = $1,300 this week.
